Emtee returned to the Midrand Magistrate’s Court on 15 September, but his case was postponed to 2 October while the NPA considers representations seeking the withdrawal of charges.
Emtee’s legal case has been postponed again while the National Prosecuting Authority considers representations from his lawyers asking for the charges against him to be withdrawn.
The rapper, whose full name is Mthembeni Ndevu, appeared briefly in the Midrand Magistrate’s Court on 15 September. The matter was postponed to 2 October for the outcome of those representations.
The latest court appearance follows a turbulent period for the artist. Emtee was released on R2,000 bail on 2 September after spending 16 days in Johannesburg Correctional Centre. The case relates to an alleged violation of a 2023 protection order obtained by his estranged wife, Nicole Chinsamy.
The protection order restricts him from publishing material about Chinsamy on social media. Chinsamy has since submitted a formal withdrawal statement and told the court that she wanted to close the chapter and move on.
That withdrawal does not itself end the criminal process. The decision now sits with prosecutors, which is why the October date matters.
Away from court, Emtee has resumed performing. That creates two parallel timelines around one of South African hip-hop’s most recognisable artists: a career moving back onto stages while a legal matter remains unresolved.
The distinction is important. A return to performances is not the same as a resolution of the case, and the pending representations should not be treated as if the charges have already been withdrawn.
The next substantive update is expected when the matter returns to court on 2 October, unless the NPA communicates a decision before then.
